These terms are an agreement between you and Axiomatrix, Inc. (“eHopp”, “we”, “us”), which operates eHopp, an event registration, ticketing and attendee messaging service. By using eHopp you agree to these terms and to our Privacy Policy. If you use eHopp for an organization, you agree on its behalf.

Accounts

Give accurate information, keep your sign-in details secure, and tell us promptly about any unauthorized use of your account. You are responsible for what happens in your account. You must be old enough to form a binding contract where you live to create an account.

Organizers

Organizers are responsible for their events: the event description, its accuracy, pricing, capacity, refund policy, and running the event itself. Organizers must have the right to contact the people they message through eHopp, must collect and respect consent as the law requires, and must comply with the laws that apply to their events, including consumer protection, privacy, tax and anti-spam laws.

Attendees and tickets

When you register for or buy a ticket to an event, your agreement for the event is with its organizer, and the organizer’s terms and refund policy apply. eHopp provides the service the organizer uses but does not run the event and is not responsible for it. Tickets may not be resold or transferred unless the organizer allows it.

Payments and fees

Payments are processed by our third-party payment processor, whose terms also apply. Any fees are shown before you pay. Refunds are issued according to the organizer’s refund policy, except where the law requires otherwise. Organizer subscription fees and payouts are governed by the plan and payout terms shown in the organizer console.

Acceptable use

You may not use eHopp to:

  • break the law or infringe anyone’s rights;
  • send messages to people who have not agreed to receive them, or spam;
  • run fraudulent, misleading or unlawful events, or sell counterfeit tickets;
  • upload malware, probe or disrupt the service, or access accounts or data that are not yours;
  • scrape the service or resell it without our written permission.

We may remove content, suspend events or close accounts that break these terms.

Your content and ours

You keep ownership of the content you add to eHopp, and you give us the permission we need to host, display and deliver it to provide the service. eHopp, its software and its branding belong to us and our licensors; these terms give you no rights to them other than to use the service.

SMS terms

Program. eHopp sends text messages about events you registered for: reminders before an event starts, updates such as a change of venue or time, and occasional offers from the event’s organizer. Messages are sent by eHopp on behalf of the organizer and begin with “eHopp:”.

Opting in. You receive texts only after you agree to them, by ticking the text-message option on your eHopp message preferences. Consent is not a condition of any purchase.

Frequency and cost. Message frequency varies with the events you register for. Message and data rates may apply.

Opting out. Reply STOP to any message to stop receiving texts; we will confirm and send nothing more. Reply START to receive texts again. You can also turn texts off in your message preferences.

Help. Reply HELP to any message, or email ehopp-support@axiomatrix.io.

Carriers. Mobile carriers are not liable for delayed or undelivered messages. Delivery depends on your carrier and device.

Privacy. We do not sell or share your mobile number or text-message consent with third parties for their marketing. See the Privacy Policy.

Third-party services

eHopp relies on third-party services, such as payment processing and message delivery. We are not responsible for services we do not control, and their own terms may apply.

Disclaimers

eHopp is provided “as is” and “as available”. To the extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not promise that the service will be uninterrupted or error-free.

Limitation of liability

To the extent the law allows, eHopp is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim about the service is limited to the greater of the fees you paid us in the 12 months before the claim and US$100. Some places do not allow these limits, so they may not apply to you.

Indemnity

If you are an organizer, you will defend and indemnify eHopp against claims arising from your events, your content, your messages, or your breach of these terms or the law.

Ending your use

You may stop using eHopp at any time. We may suspend or end your access if you break these terms or if we must for legal reasons. Sections that by their nature should survive will survive.

Governing law

These terms are governed by the laws of the State of Washington, United States, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in King County, Washington, unless the law where you live gives you the right to bring them elsewhere.

Changes to these terms

We may update these terms. We will post the new version here with a new “last updated” date and, if the changes are significant, tell you in advance. Continuing to use eHopp after a change means you accept it.
